Prevailing Wage Ordinance

2019 Prevailing Wage Act Amended

Public Act 100-1177 was signed into law, which amends the Prevailing Wage Act (820 ILCS 130). The bill will take effect on June 1st, 2019 with the following changes:

  • Public bodies are currently required to have contractors submit certified payroll records and to keep those records for 5 years from the date of the last payment. By April 1, 2020, Illinois Department of Labor (IDOL) is required to create an electronic database that will accept payrolls.  Once the database is developed, contractors must directly submit certified payrolls to the online database.  This new process will eliminate the public body from having to store such records.
  • Public bodies will no longer be required to determine the prevailing wage rate.  Instead, prevailing wage schedule will follow wages that are published on the IDOL website.
  • Public bodies will no longer be required to approve an annual prevailing wage ordinance or resolution each June. 
  • Public bodies will not have to publish the annual notice of approval in the newspaper or on its website.
